What are bed bugs?

Bed bugsare parasites that have existed since ancient times. For nearly 50 years, they have been dormant, but unfortunately we are now experiencing a widespread recurrence of bed bugs in Hawaii and all across the United States. They are small wingless insects that are reddish brown, flattened, oval, with microscopic hairs that give them a banded appearance. They grow to about 1/8" in length. Bed bugs are generally nocturnal and feed exclusively upon the blood of humans and warm-blooded animals.

It is important to remember that a bed bug infestation is not a sanitation or housekeeping issue. They are resourceful hitchhikers and are typically transported in or on luggage, clothing, or other belongings unknowingly by individuals as they travel. Current outbreaks have been traced to increased domestic and international travel. Bed bugs are a particular problem for hotels, motels, hospitals and apartments, where the turnover rate of occupants is constant. Infestations can also occur accidentally by bringing home infested furniture, mattresses or used clothing.

Bed bugs will feed on any warm-blooded animal, but they prefer the blood of humans. Fortunately, they are not known carriers of any diseases, but bed bug bites often cause red, itchy welts. Antihistamines and corticosteroids may be given to help relieve the itching. Approximately 50% of bed bug victims do not show any evidence of bites.

Bed Bugs in Rental Housing | VALegalAid

Virginia law does not specifically mention bed bugs. The law does not explicitly say whether landlords or tenants are responsible for getting rid of bed bugs. Virginia law does require all landlords to follow building and housing codes affecting health and safety, and to make all repairs needed to keep the place fit and habitable. Because bed bugs make rental housing not habitable, this means landlords are responsible for getting rid of bed bugs.

Under the Virginia Residential Landlord Tenant Act (VRLTA), tenants must keep their rental units free from insects and pests. They also must promptly notify the landlord of the existence of any insects or pests. Notification of the landlord makes no sense unless the landlord also is responsible for getting rid of insects and pests, including bed bugs. If a tenant does not promptly report insects and pests, including bed bugs, the tenant could be responsible for the added cost of treatment due to the tenants delay in reporting.

Tenants covered by the VRLTA must promptly report insects and pests. Tenants not covered by the VRLTA should promptly report insects and pests. Tenants are covered by the VRLTA if they live in an apartment building or in multi-family housing. Multi-family housing means sharing heating, hot water, entry and exit, or some other service with another dwelling unit in the same building. Tenants also are covered if their landlord rents out more than ten single-family homes. In cities and in urban counties, tenants are covered if their landlord rents out more than four single-family homes.

A March 15, 2011 memo from the U.S. Department of Housing and Urban Development (HUD) suggests that responsibility for bed bug treatment lies with the landlord. Highlights of the March 15, 2011 memo include the following:

Downstate New York (New York City, Long Island, and the southern portion of the Hudson Valley) can be considered to form the central core of the Northeast megalopolis, an urbanized region stretching from New Hampshire to Virginia.

The major cities of the state developed along the key transportation and trade routes of the early 19th century, including the Erie Canal and railroads paralleling it. Today, the New York Thruway acts as a modern counterpart to commercial water routes.[65]

The distribution of change in population growth is uneven in New York State; the New York City metropolitan area is growing considerably, along with Saratoga County; while most of Western New York is nearly stagnant. The United States Census Bureau estimates that the population of New York was 19,746,227 on July 1, 2014, a 1.9% increase since the 2010 United States Census.[4] Despite the open land in the state, New York's population is very urban, with 92% of residents living in an urban area,[68] predominantly in the New York City metropolitan area.

Two-thirds of New York State's population resides in New York City Metropolitan Area. New York City is the most populous city in the United States,[69] with an estimated record high population of 8,491,079 in 2014,[63] incorporating more immigration into the city than emigration since the 2010 United States Census.[70] More people live in New York City than in the next two most populous U.S. cities (Los Angeles[71] and Chicago[72]) combined, which, according to the United States Census Bureau, is estimated to total 6,572,655. Long Island alone accounted for a Census-estimated 7,740,208 residents in 2013, representing 39.4% of New York State's population.[23][24][25][26]

New York is home to the second-largest African-American population (after Georgia) and the second largest Asian-American population (after California) in the United States. The New York City neighborhood of Harlem has historically been a major cultural capital for African-Americans of sub-Saharan descent, and Bedford-Stuyvesant in Brooklyn has the largest such population in the United States.

Queens, also in New York City, is home to the state's largest Asian-American population and is the most ethnically diverse county in the United States; it is the most ethnically diverse urban area in the world.[88][89] Queens is home to the largest Andean (Colombian, Ecuadorian, Peruvian, and Bolivian) populations in the United States.

New Jersey’s laws designed to spread bed bugs in rental …

Many local laws make it easier for bed bugs to spread, and New Jerseys laws are among them.

As noted on our FAQ about who pays for treatment, the New Jersey Warranty of Habitability says landlords have to keep rental apartments pest-free.

However, things can be a bit more complicated than that.

Although the law says NJ landlords have to pay to eliminate bed bugs from rental units, they dont say landlords cant then turn around and charge tenants to cover the costs.

This Journal article details an example of this in action: seniors living in low-income housing, the 240-unit Grandview Terrace in Jersey City, are suffering badly from bed bugs, and have been for three years. Fifty units are now known to have them:

The state holds landlords responsible for extermination in multi-unit buildings of three or more apartments if the bugs are found in two or more units or in common areas. But the state doesnt take a stance as to whether landlord can then turn around and charge the tenants, said Jennifer Monaghan of the state Department of Community Affairs.

One-and two-family buildings are regulated by a different set of laws that can be superseded by municipal law, but in general the rules are the same: the owner is responsible, but has the right to include a provision in the lease charging the costs back to the tenants.

But despite the law most Jersey City landlords are shouldering the costs, said Charles Odei, director for Jersey Citys Division of Tenant Landlord Relations. With all the other cases (but Grandview Terrace) weve been successful in getting the landlord to pay so far, he said.

The 284-unit Grandview Terrace has had nearly 50 cases of bedbugs in the past three years, said Steve Lesko, president of Norman Ostrow Inc., which manages the building. He said the buildings tenant board voted in 2006 to charge tenants individually.

Why should people who dont have a problem pay for people who do? he said, adding that the policy tends to prevent false alarms.
