Bed bugs are a growing problem in nursing homes and elderly care assisted living centers across the state of California. Each day we get calls from victims of bed bug bites seeking recovery against property owners. In a recent case we were asked to represent an individual who was badly bit at a nursing home or skilled nursing home facility. After reviewing the case we felt strongly about our clients position and have decided to pursue the cause of action. Bed bugs in a nursing homes are serious problem. These conditions if left untreated can cause significant injuries. If a nursing home fails to properly remediate this issue, they will be held liable for injuries sustained. Also, if it is found that they had knowledge of the condition, but failed to correct it then they will be liable for injuries sustained.

When a nursing home patient gets bed bugs they are more likely to suffer from a subsequent infection. Infections can rapidly spread at nursing homes if left improperly treated. Bed bug bites can develop into rashes and chaff causing bleeding and swelling, which can become infected. These infections can develop into serious issues if not properly cared for.

Nursing homes are required to properly inspect and treat for bed bugs found at a facility which they own or operate. Since a number of patients can come in and out of their facilities, it is not uncommon for bed bugs to be found on the property. However, some nursing homes are negligent in the care of their patients and fail to properly safeguard against these conditions. When a nursing homes fail to put into place safeguards and safety measures to correct or remedy these issues they will be considered liable for injuries sustained as a result.

Who is liable for injuries when bed bugs are contracted at a nursing home? A nursing home will be liable when bed bugs are contracted by a patient. Courts will determine whether they had knowledge and whether they took proper precautions when dealing with the issue. Many facilities will ignore the problem, says Farid Yaghoubtil attorney with Downtown L.A. Law Group. They rely on lack of knowledge as a tool. Since many people may not know that the swelling is a bed bug bite, it is easy to get around the issue. In other cases we have seen facilities flat out deny or lie about having any knowledge only to find out they did.

In many cases nursing homes know of this issue since patients are regularly checked on by trained staff, particularly at skilled nursing facilities. These issues are reported by nurses to management, who either abruptly discharges the patient or fails to do anything to correct the issue. In such cases the nursing home will be considered liable for the injuries caused by their negligence.

Campus resources for bed bug detection – CU Boulder Today

CU Boulder Facilities Management and Environmental Health and Safety staff this month have treated one classroom in the Fleming Law building and one in Koelbel Building for the possible presence of bed bugs.

These events present an opportunity for the campus to not only create awareness around an issue that has in recent years become an increasing problem for universities and other facilities across the country but also to inform students and employees about treatment methods CU Boulder uses and available resources for mitigating against the insects.

No bugs, dead or alive, have been found in Fleming 155 or Koelbel S135. However, inspections of the rooms led scent-detection dogs to alert their handlers to the possible presence of live forms of the bugs, which could include eggs, in three areas of Fleming 155 and in one wall-mounted television in Koelbel S135. Those rooms were both closed and underwent thermal treatments. Follow-up inspections by the canines confirmed no further presence of any live forms of the bugs, and the rooms were deemed safe and re-opened.

The thermal treatment CU Boulder uses is a non-pesticide treatment proven to be the only method that effectively kills all forms of bed bugs (adults, juveniles and eggs). The treatment involves heating an area to 130 degrees Fahrenheit for several hours. There are no chemical residues left behind that could lead to skin irritations or other adverse effects. The rooms are safe to re-enter once temperatures have returned to normal. CU Boulder, however, does not re-open affected rooms until follow-up inspections confirm that treatments were successful.

If bed bugs are found on campus

Facilities Management plans to conduct periodic follow-up inspections of the affected rooms in Fleming and Koelbel to ensure the insects have not been reintroduced. However, it is important to note community awareness also plays a key role in helping to identify the source of insects and prevent reintroduction.

Anyone who frequents Fleming 155 or Koelbel S135 is encouraged to be on the lookout for bed bugs both at work and at home. Providing this information to Facilities Management can prove invaluable in more effectively preventing reintroduction to campus, as staff can consult on mitigation strategies with anyone who discovers bed bugs at home.

According to the Centers for Disease Control and Prevention, bed bugs can be found around the world, and their presence is not determined by the cleanliness of the living conditions where they are found. Bed bugs are not known to spread disease, although their bites can cause allergic reactions.

The university encourages anyone who notices or suspects bed bugs in an office, classroom, residence hall, family housing apartment or anywhere else to notify Facilities Management as soon as possible. The university provides free pest-control services to campus departments, and von Bleichert can also advise students and employees on how to deal with the bugs if they spread to their homes.
