The common bed bug (Cimex lectularius) has long been a pest feeding on blood, causing itchy bites and generally irritating their human hosts. Bed bugs are not known to transmit or spread disease. However, they can cause a number of problems, including emotional and economic distress from lack of sleep.

There are no state or local laws regarding the presence of bed bugs in rental property. There is no Springfield or Greene County law that forces property owners or landlords to take steps to remove bed bugs. Disputes about payments and responsibilities between renters and landlords are civil matters, not something the city or county has jurisdiction over.

If you are a renter with bed bugs, you have the following options:

Preventing Bed Bugs Bed bugs hitch rides in luggage, boxes, shoes and other mobile objects. They aren't tied to unsanitary living areas, so you can keep a clean house and still get them. You may have no idea they are present because they normally feed when you are sleeping.

Be thorough when buying used home items and if purchasing from rent-to-own stores. Before bringing these items home inspect each item thoroughly. Never take bedding or furniture that has been left on the curb for disposal.

When traveling, survey your hotel room for signs of bed bug infestations, such as red or dark brown spots on bed sheets. Lift the mattress, and other furniture items to look for bed bug hiding places. Elevate all luggage and personal items. Use racks to keep these items away from carpets and beds or place items in the bathtub. Examine all luggage and personal items before returning home to prevent bed bug migration.

Identifying Bed Bugs Bites alone are not a very good method of confirming that you have bed bugs. Its far better to check for the bugs themselves, which are perfectly visible to the naked eye if you know where to look. Adults are brown in color, although their bodies redden after feeding. Full-grown bed bugs move relatively slowly and measure between 4 to 5 mm, with newly hatched bugs being much smaller and white in color. When not feeding, bed bugs like to hide in the piping of mattresses or other small cracks and crevices in and around the bed.

The EPAs website contains detailed information about identifying bed bugs. If you are bitten, there are a number of simple steps you can take to treat the bites.

Getting Rid of Bed Bugs The best and most proven way to get rid of bed bugs is to kill them with high heat temperatures of at least 113 degrees for at least one hour are necessary. The higher the temperature, the shorter the time needed to kill bed bugs at all life stages. Put bedding and clothing in the dryer at high temperatures to kill bed bugs (just washing will generally not kill bed bugs).

Bedbugs discovered twice recently in Topeka VA medical unit – Topeka Capital Journal

Bedbugs were found last week and again Tuesday night in a medical unit at the Topeka VA Medical Center.

When the bedbugs were discovered last week, eradication efforts began immediately, said Joseph Burks, public affairs officer for the VA Eastern Kansas Health Care System.

Patients returned after an inspection showed the area was clear. Late Tuesday night, one dead bug and one live bug were found in the same unit, Burks said.

Our team is aware and taking action in moving patients out safely and efficiently, he said. Our environmental management service is working with exterminators and taking extra measures in re-evaluating and treating the unit again.

The bedbugs were first treated with insecticide, but heat will be used to eradicate them this time. Heat is able to penetrate into small crevices and kill bedbugs in all stages, Burks said.

When a bedbug is confirmed on a patient or in a room, the room is sealed off and pest control is contacted. The room is closed anywhere from two to 24 hours depending on the infestation and treatment. Pest control rechecks the room, and the VAs environmental management service cleans and reopens it, Burks said.

It is reported that nearly all pest professionals at some time or another have treated bedbugs and that one out of five Americans has had a bedbug infestation in their home or knows someone who has encountered bedbugs at home or in a hotel, Burks said.

He added that research has shown that bedbugs dont transmit diseases, though they may cause itchy red welts.

In October 2016, bedbugs were found in an administrative building on the Topeka VAs campus.

Small, oval insect that feeds on humans in the night.

Bed bugs originated in the Middle East and were transported around the world on human beings. Originally discovered in North America in 1748, they were virtually eliminated in the U.S. during the 1940s through the use of DDT. However, due to increases in international travel and pesticide regulations, they have become more common in recent years. Although bedbugs have been associated with over 25 different disease organisms, they are not known to transmit diseases to humans. However, their bites may result in itchy, red welts often found in lines or clusters on the body.

These bugs are 3/16 of an inch long; oval and flattened; can survive 6-7 months without feeding.

Females deposit 1 to 5 eggs per day over a 2-month period; average of 200 eggs per female.

Life cycle: egg to adult in 21 days at 86F; egg-laying inhibited below 60F.

Bed bugs have a simple metamorphosis (egg-nymph-adult) with five nymph instars.

These bugs are nocturnal; feeding after dark. They only feed on blood (primarily human).

They cause an allergic reaction 80% of the time.

They typically live within the cracks and crevices in or around bedding and furniture.

Large infestations emits a sickly-sweet, raspberry-like odor.

They deposit fecal pellets (spots) here and there on surfaces (e.g., corners of furniture).

They are introduced into new areas via bedbug-infested humans, belongings and furniture.

Look for these bugs in and around mattress buttons and beading, box springs and crevices of wooden bed frames.

They can be found behind picture frames and within nightstands, under baseboards and floor board cracks and around door and window frames.

They will live inside stuffed furniture such as sofas and recliners and behind loose wallpaper as well as inside electric sockets and along electrical conduits.

Have been found in buses, boats, trains and airplanes.

Can also be seen along ceiling and wall junctures as well as behind curtains.

California Landlord-Tenant Law is Crawling with New Statutes About Bed Bugs – Lexology (registration)

Although bed bugs are small and do not transmit diseases, they can cause giant problems. Their bites can cause severe allergic reactions and secondary skin infections and their presence can lead to significant economic consequences, as well as mental health problems for people residing in infested places.

Multi-unit apartment buildings provide particularly fertile environments for bedbugs, as new tenants may bring new bed bugs and infestations may easily spread to adjacent units. The California legislature has not taken the bed bug problems lying down. It recently imposed statutory duties regarding bed bugs on both landlords and tenants.

New Laws with Bite The legislature amended the California Civil Code to protect tenants who complain about bed bugs. New subsection 1942.5(a)(1), effective on January 1st, 2017, forbids landlords from raising rents, reducing services, or otherwise retaliating against a tenant who notifies or complains to the landlord about a suspected bed bug infestation. This amendment merely clarifies that longstanding laws protecting tenants from retaliation for making habitability complaints include complaints about bed bugs.

California Civil Code sections 1954.600 et seq., which also went into effect on January 1st, impose new duties on both landlords and tenants. Section 1954.602 provides that a vacant unit that a landlord knows to be currently infested with bed bugs may not be shown, rented, or leased. The statute does not impose a duty on landlords to inspect their properties for bed bugs. However, if the landlord has notice of suspected or actual infestation or if infestation is evident on visual inspection, the landlord is presumed to know about the infestation.

New Civil Code section 1954.603 provides that commencing on July 1, 2017, landlords must notify new tenants in at least 10-point font of the following: "General information about bed bug identification, behavior and biology, the importance of cooperation for prevention and treatment, and the importance of and for prompt written reporting of suspected infestations to the landlord." The statute provides the language necessary to comply with the notice requirements. Landlords are also required to notify new tenants about the "procedure to report suspected infestations to the landlord." The notifications required in this statute must be provided to all tenants by January 1, 2018.

Section 1954.604 requires tenants to cooperate with pest control operators who seek to enter their units to inspect units for bed bugs.

Finally, section 1954.605 directs landlords to furnish a copy of a pest control operators report to tenants whose units were inspected for bed bugs. The report must be provided to the tenants within two business days of receipt of the pest control operators findings. If the pest control operator finds bed bug infestations in common areas such as building hallways, shared laundry rooms and staircases, elevators, and designated garbage areas, notice must be provided to all tenants.

Wallet Infestation Bed bug infestations may inflict landlords with painful figurative bites. Even before the new California statutes took effect, lessors who ignored bed bug infestations were sued in individual actions and multi-party lawsuits for negligence, constructive eviction, breach of warranty of habitability, negligent infliction of emotional distress, breach of the covenant of quiet enjoyment, nuisance, and other causes of action. In some circumstances, landlords who lost these lawsuits had to pay the tenants attorneys fees. For instance, in the recent case of Hjelm v. Prometheus Real Estate Group, Inc., 3 Cal.App.5th 1155 (Cal. Ct. App. 2016), the California Court of Appeal affirmed an award against a lessor of $326,475 in attorneys fees on a $72,000 judgment.

Counsel Concerning Critters One obvious suggestion for avoiding lawsuits over bed bug infestations: Dont let the bed bugs bite. Landlords might save money in the long-term by hiring pest control operators in the short-term to regularly inspect tenant units. These regular appointments may head off infestations. Furthermore, they may make the exterminator, rather than the landlord, liable in a tenants negligence action stemming from bed bug infestations.

Of course, landlords must follow the dictates of the law. They may not retaliate against tenants who complain about bed bugs, rent out infested property, or fail to disclose bed bug problems to affected tenants. Even if there is no infestation, landlords must provide new tenants notice about bed bugs beginning on July 1, 2017 and must do the same for all tenants beginning on January 1, 2018.

The new statute requiring tenants to provide necessary access to pest control operators should provide landlords with legal recourse against tenants who refuse to cooperate.

Bed bugs infestations can make landlords want to hide under their covers. But both landlords and tenants will sleep easier if they understand the laws concerning bed bugs.
