Does Your State Law Say Anything About Bed Bugs?

Bed bugs are horrifying. The mere thought of bed bugs strikes a deep fear within me, shaking me to my core. Theyre a big concern for anyone renting housing, and in more active rental markets they can be scarily common. After learning that bed bugs are more likely to breed and feed (ew) in the summer months, I decided to look into the laws that surround pest infestation in the United States.
Only 21 states have laws regulating bed bug infestation; some of those state laws only deal with hotels and offer no guidance to landlords. While a rental property infested with bed bugs would likely be seen as being actively in violation of the warranty of habitability, a specific law addressing bed bugs will offer you some protection and peace of mind. Find your state below to see whether your state requires landlords to take action when it comes to bed bugs.
Alabama
Alabama state law addresses bedbug infestations in hotels, but there is no law that specifically requires landlords to deal with an infestation in a rental unit.
Alaska
Alaska state law does not address bed bugs.
Arizona
Arizona state law requires landlords to give bed bug educational materials to all tenants. Its against the law for a landlord to knowingly rent a unit that is infested with bed bugs. Tenants are legally barred from bringing any belongings that are infested into a rental unit. At the same time, Arizona law prevents cities and towns from implementing laws about bed bugs unless the laws control how to dispose of any items that are infested.
Arkansas
Arkansas state law does not address bed bugs. Another reason to not rent in Arkansas.
California
California state law states that it is illegal for a landlord to show or rent any unit that has a bed bug infestation. If a unit is inspected by pest control, a landlord must report to the tenants the results of the inspection within 2 days. Landlords are required to provide tenants with educational material about bed bugs when they move in.
Colorado
Colorado state law does not address bed bugs.
Connecticut
Connecticut state law sets guidelines for both landlords and tenants when it comes to handling bed bugs. Tenants must promptly notify a landlord orally or in writing if they suspect that their unit is infested. Landlords then have 5 days to have the unit inspected and report the results to the tenant within 2 days. If the unit is infested, the landlord has 5 days to get it treated by a pest control professional. Your landlord is barred from renting a unit that they know is infested. Connecticuts law surrounding bed bugs is one of the most specific ones in the country - it even demands that a landlord vacuum before treating a unit for pests.
Delaware
Delaware state law does not address bed bugs.
Florida
Florida state law says that landlords are required to take reasonable steps to exterminate bed bugs in a rental unit.
Georgia
Georgia state law demands that hotels exterminate any pests, but offers no legal guidance for landlords.
Hawaii
Hawaii state law does not address bed bugs.
Idaho
Idaho state law does not address bed bugs.
Illinois
Illinois state law does not offer any landlord-specific guidance on how to handle bed bugs. The only state law that mentions bed bugs says that railroad operators cant operate unless they know their train is free of pest infestation.
Indiana
Indiana state law does not address bed bugs.
Iowa
Iowa state law only speaks to bed bugs in migrant labor camps. Helpful.
Kansas
Kansas state law defines a bed bug infestation as an imminent health hazard.
Kentucky
Kentucky state law does not address bed bugs.
Louisiana
Louisiana state law does not address bed bugs.
Maine
Maine state law demands that, if a tenant notifies a landlord of a bed bug infestation, the landlord must conduct an inspection of the unit within 5 days. If the unit is infested, the landlord has 10 days to schedule a treatment from an insured pest control company. A landlord has to tell any prospective or new tenants if a unit or its surrounding units have are currently infested, and cannot rent any infested unit. If your landlord fails to follow this law, they will be forced to pay at least a $250 penalty fee, and possibly pay for any damages.
Maryland
Maryland state law does not address bed bugs.
Massachusetts
Massachusetts state law does not address bed bugs.
Michigan
Michigan state law does not address bed bugs.
Minnesota
Minnesota state law only addresses bed bug infestations in hotels and nursing homes.
Mississippi
Mississippi state law does not address bed bugs.
Missouri
Missouri state law does not address bed bugs.
Montana
Montana state law does not address bed bugs.
Nebraska
Nebraska state law only addresses bed bugs by saying two things: you are allowed to treat for bed bug infestations outdoors as long as you take steps to prevent drift or runoff of the chemicals, and any housing facility for developmentally disabled people must take steps to prevent infestations.
Nevada
Nevada state law only addresses bed bug infestations in hotels or labor camps.
New Hampshire
New Hampshire state law restricts landlords from renting bed bug infested units. Landlords are required to periodically inspect all of their rental units for infestation. If a landlord tells a tenant that a treatment for bed bugs has been scheduled and the tenant fails to give the necessary access to the unit, the landlord has the right to evict the tenant. Landlords are financially responsible for bed bug treatments and are legally required to investigate any report of infestation from a tenant.
New Jersey
New Jersey stare law does not address bed bugs.
New Mexico
New Mexico state law does not address bed bugs.
New York
New York state law only addresses bed bug infestations in public schools. New York City law demands that all landlords give new tenants a form detailing the propertys history of bed bug infestation that goes back one year. New York City law also demands that your landlord take care of (aka pay for) treatment to get rid of bed bugs.
North Carolina
North Carolina state law does not address bed bugs.
North Dakota
North Dakota state law does not address bed bugs.
Ohio
Ohio state law only addresses bed bug infestations in hotels.
Oklahoma
Oklahoma state law does not address bed bugs.
Oregon
Oregon state law demands that any facts about a bed bug infestation remain confidential.
Pennsylvania
Pennsylvania state law only addresses bed bug infestations that occur in seasonal farm labor camps.

Bed bug bites: The subtle sensation on your skin that means youve been bitten – Express
The nightmare does not end there - bed bug bites can cause allergic reactions in some people, warns the NHS.
As the health body explains, they can be very itchy and there may be painful swelling.
"A severe allergic reaction (anaphylaxis) is also possible but rare," it says.
Anaphylaxis is a severe and potentially life-threatening reaction to a trigger such as an allergy.

Bedbug bites usually clear up on their own in a week or so but there are things you can do to alleviate symptoms.
The NHS recommends the following:
You can also ask a pharmacist about using a mild steroid cream like hydrocortisone cream to ease bed bug bites, the health body says.
If the bites are very itchy and you're unable to sleep, a pharmacist may recommend antihistamines, it adds.
Once your symptoms are treated, you must tackle the underlying infestation.
"This can be difficult because bed bugs hide so well and can live several months without eating," notes Mayo Clinic.
It adds: "Your best bet may be to hire a professional exterminator, who may use a combination of pesticides and non-chemical treatments."
Non-chemical treatments may include:
"Some professional exterminators use portable devices to raise the temperature of a room to a lethal temperature," says Mayo Clinic.
According to the NHS, there are a number of precautions you can take to stop them coming back.
The health body says to not take luggage or clothing indoors without checking it carefully if you have come from somewhere where you know there were bedbugs.

Bed bugs, fire hazards and mold: Inside Alabamas worst …
Bed bugs. Broken or painted over sprinklers. Broken doors and windows that wont lock. Mold on ceilings and walls.
These are just some of the dangerous and unsanitary conditions people living in Alabamas worst public housing properties live with every day.
Across Alabama, most public housing passes federal inspection with flying colors. Look below to see how each property did. However, there were several failures, according to the latest federal data from March 2019.
In all, there are 259 single family public housing properties in Alabama, and 18 of them received scores lower than 60 as of March 2019. Of the 476 multi-family public housing properties in the state, 17 scored lower than 60.
That means a failing property rate of 4.76 percent. Thats actually better than the nation as a whole - the national rate is 4.86 percent, according to the Department of Housing and Urban Developments Real Estate Assessment Center.
However, those at the bottom, such as Central Plaza in Mobile, were noted to have serious problems.
Public housing properties in the United States are subject to physical inspections by HUD, and these inspections come with REAC inspection scores, a 0-100 score that determines whether a facility is fit to live in.
These inspections - and the scores that go with them - are looking to make sure [housing units] are decent, safe, sanitary and in good repair, said Joe Phillips, with the HUD Atlanta regional office of public affairs.
Any property that scores below a 60 in a REAC inspection is considered failing, Phillips said. A number of things can happen when a property receives a failing score. They can be fined, their Section 8 funding can be terminated or abated, or they can be put under new management, among other things. But a property manager or owner is given time to address the problems if they score between 31 and 59.
Any score 30 or below is a different story. Those properties are automatically reported to the Departmental Enforcement Center, which takes over the responsibility of handling their case from that point forward.
Only one property in Alabama scored 30 or below, as listed in the data thats publicly available from HUD. That property was Central Plaza Towers in Mobile, a low income housing project for senior citizens. It scored a 30 on its REAC inspection on May 29th, 2018, according to data from HUD.
A copy of the REAC inspection summary acquired by AL.com showed bed bugs were reported in 61 percent of inspected units at Central Plaza, and that 24 of 26 inspected units had inoperable call-for-aid stations.
Michael Pierce, executive director of the Mobile Housing Board, said he had taken office in late March 2019 - nearly a year after the REAC inspection in question - and could only address the report in general terms.
What had transpired in the previous administration, Im not certain of everything that transpired, but what I can tell you is that progress is being made in terms of the overall physical conditions out at Central Plaza Towers, he said.
The May 2018 inspection would have taken place during the short tenure of MHB Executive Director Akinola Popoola, who was fired in September 2018 after less than a year on the job. Popoola has filed suit over his dismissal, which the board attributed largely to a lack of responsiveness and failures of financial oversight.
Pierce said hed been working to straighten out problems that had damaged the Mobile Housing Authoritys relationship with the federal Department of Housing and Urban Development even before Popoolas hiring. That has taken precedence over everything else, literally to get our house in order, thats where weve been expending all our energy and time, making certain that we are a sound, well-run organization, he said. I have worked extremely hard to improve our relationship with our regulatory authority, meaning HUD.
Another property, Joseph Loveman Village in Birmingham, showed a 33 in the HUD dataset, but a 30 on the REAC inspection summary. Loveman Village was in the process of vacating its residents for a complete demolition and redevelopment at the time of the inspection - August 2018.
Some of the violations reported there included bed bugs, refrigerators and stoves in some units either missing or not working and windows that couldnt be locked.

Bed bug bites: The unsettling sign in your mood that could signal youve been bitten – Express
Bed bugs are a nuisance - they often dwell in parts of the house that are hard to access and they have a penchant for animal and human flesh. The parasitic insects feed on the blood of people and animals while they sleep. In the morning you may wake up to find a trail of red, itchy bite marks on your skin.
The bite marks do not usually present a real threat to your health, although, as the NHS points out, some people have a reaction to the bites.
"They can be very itchy and there may be painful swelling," explains the health body.
What is often overlooked is the psychological effects of bed bug bites.
Research is starting to show that bed bug infections can leave people with anxiety, depression, and paranoia.

In fact, these symptoms are highly prevalent, according to Stphane Perron, a doctor and researcher at the University of Montreal. Speaking to The Atlantic, he said: If you have bed bugs, and if you dont care, thats not a normal reaction. You should be worried. I would consider it a normal reaction to a stressor.
Perron is well versed in this subject, having published a number of papers on the psychological ramifications of bed bugs.
In one study, he and his team looked at apartments that had been reported to the Montreal Public Health Department for unsafe conditions.

Some of those units were infested with bedbugs, but not all of them.
Perron and his team gave the tenants of these buildings a series of questionnaires that assessed all sorts of health impacts, including psychological ones.
All told, 39 of the units had bed bugs, and 52 of them didnt.
When they compared the psychological results between those two samples a method that helps to control for factors that impact mental health like socioeconomic status they found that tenants with bed bugs were far more likely to report anxiety and sleep disturbances than those without.
Another study by medical entomologist Jerome Goddard at Mississippi State University strengthens the association.
Goddard examined posts on bed bug related websites like Bedbugger.com.
When they compared those posts against a checklist of PTSD symptoms they found that 81 percent of people writing these forum posts were describing psychological and emotional effects often associated with the disorder, things like hyper-vigilance, paranoia, obsessive thoughts, and depression.
According to the Centres for Disease Control and Prevention (CDC), bed bug infestations are commonly treated by insecticide spraying.
"If you suspect that you have an infestation, contact your landlord or professional pest control company that is experienced with treating bed bugs," advises the CDC.
There are some self-help tips you can try to stamp out an infestation too.
The NHS recommends washing affected bedding and clothing use a hot wash (60C) or tumble dry on a hot setting for at least 30 minutes.
