California Landlord-Tenant Law is Crawling with New Statutes About Bed Bugs – Lexology (registration)

Although bed bugs are small and do not transmit diseases, they can cause giant problems. Their bites can cause severe allergic reactions and secondary skin infections and their presence can lead to significant economic consequences, as well as mental health problems for people residing in infested places.

Multi-unit apartment buildings provide particularly fertile environments for bedbugs, as new tenants may bring new bed bugs and infestations may easily spread to adjacent units. The California legislature has not taken the bed bug problems lying down. It recently imposed statutory duties regarding bed bugs on both landlords and tenants.

New Laws with Bite The legislature amended the California Civil Code to protect tenants who complain about bed bugs. New subsection 1942.5(a)(1), effective on January 1st, 2017, forbids landlords from raising rents, reducing services, or otherwise retaliating against a tenant who notifies or complains to the landlord about a suspected bed bug infestation. This amendment merely clarifies that longstanding laws protecting tenants from retaliation for making habitability complaints include complaints about bed bugs.

California Civil Code sections 1954.600 et seq., which also went into effect on January 1st, impose new duties on both landlords and tenants. Section 1954.602 provides that a vacant unit that a landlord knows to be currently infested with bed bugs may not be shown, rented, or leased. The statute does not impose a duty on landlords to inspect their properties for bed bugs. However, if the landlord has notice of suspected or actual infestation or if infestation is evident on visual inspection, the landlord is presumed to know about the infestation.

New Civil Code section 1954.603 provides that commencing on July 1, 2017, landlords must notify new tenants in at least 10-point font of the following: "General information about bed bug identification, behavior and biology, the importance of cooperation for prevention and treatment, and the importance of and for prompt written reporting of suspected infestations to the landlord." The statute provides the language necessary to comply with the notice requirements. Landlords are also required to notify new tenants about the "procedure to report suspected infestations to the landlord." The notifications required in this statute must be provided to all tenants by January 1, 2018.

Section 1954.604 requires tenants to cooperate with pest control operators who seek to enter their units to inspect units for bed bugs.

Finally, section 1954.605 directs landlords to furnish a copy of a pest control operators report to tenants whose units were inspected for bed bugs. The report must be provided to the tenants within two business days of receipt of the pest control operators findings. If the pest control operator finds bed bug infestations in common areas such as building hallways, shared laundry rooms and staircases, elevators, and designated garbage areas, notice must be provided to all tenants.

Wallet Infestation Bed bug infestations may inflict landlords with painful figurative bites. Even before the new California statutes took effect, lessors who ignored bed bug infestations were sued in individual actions and multi-party lawsuits for negligence, constructive eviction, breach of warranty of habitability, negligent infliction of emotional distress, breach of the covenant of quiet enjoyment, nuisance, and other causes of action. In some circumstances, landlords who lost these lawsuits had to pay the tenants attorneys fees. For instance, in the recent case of Hjelm v. Prometheus Real Estate Group, Inc., 3 Cal.App.5th 1155 (Cal. Ct. App. 2016), the California Court of Appeal affirmed an award against a lessor of $326,475 in attorneys fees on a $72,000 judgment.

Counsel Concerning Critters One obvious suggestion for avoiding lawsuits over bed bug infestations: Dont let the bed bugs bite. Landlords might save money in the long-term by hiring pest control operators in the short-term to regularly inspect tenant units. These regular appointments may head off infestations. Furthermore, they may make the exterminator, rather than the landlord, liable in a tenants negligence action stemming from bed bug infestations.

Of course, landlords must follow the dictates of the law. They may not retaliate against tenants who complain about bed bugs, rent out infested property, or fail to disclose bed bug problems to affected tenants. Even if there is no infestation, landlords must provide new tenants notice about bed bugs beginning on July 1, 2017 and must do the same for all tenants beginning on January 1, 2018.

The new statute requiring tenants to provide necessary access to pest control operators should provide landlords with legal recourse against tenants who refuse to cooperate.

Bed bugs infestations can make landlords want to hide under their covers. But both landlords and tenants will sleep easier if they understand the laws concerning bed bugs.

DCPS Rodents, Bedbug Crisis May Mean City Infestation Issue – Afro American

Following a week that identified bed bugs at Miner Elementary in Northeast, and citations by the D.C. Health department that shuttered luxury food depot Dean & Deluca and a Whole Foods both in Georgetown concerns have grown among city officials and residents that the District may soon be overrun with pests.

The District of Columbia has long been a hub for rodents with tunnels, waterways, and occasional lapses in abatement; however, the D.C. Department of Health said there has been a drastic increase in calls to report rats, following four years of steady rodent decline. The city logged more than 3,000 rat complaints in fiscal year 2015-2016, causing Mayor Muriel Bowser to launch a rat-riddance program. The program, linking the Department of Health with the National Park Service, began inspecting and treating national parks in the city, including DuPont Circle, where frequent visitors spot an average of 12 to 20 rats each visit.

The National Park Service is committed to ensuring safe, positive experiences for visitors in all of our parks, and this agreement with the D.C. Department of Health provides us better tools to control the rodent population, said Robert Vogel, director of the National Capital Region for the National Park Service, in a statement. By simplifying the reporting process and decreasing the response time for treatment of affected areas, we are working together toward a rat-free D.C.

But for parents of Savoy Elementary School, in Southeast, scheduled to reopen Feb. 27 following a temporary closure to treat both rats and bedbugs, fears have not been so easily assuaged. Despite the efforts by DCPS to proactively work to prevent and treat potential threats from pests, a recent Orkin Pest Control report noted the District has seen a 57 percent increase in its rat population stressing the increase was among rats, not mice.

Similar to large cities like Philadelphia and New York, D.C. has extended its abatement programs with increased patrols and treatments. Still, with increased property development and infrastructure improvements, including breaking open ground to modernize pipes, results are minimal.

Deputy Mayor for Education Jennifer Niles told the AFROthat abating rodents across the city, but especially in schools, required improved habits of those inside as well as structural improvements to keep vermin from entering buildings. With the rodents, it isnt always easy because with all of the construction we have in the city the displacement of one population of rats means that they go somewhere [else in the city], Niles said. We need to make sure that we have school buildings with no entry in for rodents, and when we have buildings where rodents have entered that we dont allow them to thrive. Different sites have different challenges, but these are best practices.

Ward 6 resident Donna Haskins told the AFROthat Niles assessment should be a city-wide mandate for schools, residences, and businesses. It is easy to point a finger at DCPS or the individual restaurants and businesses, like Whole Foods, but the truth [is] whether you are downtown near the Archives, east of the river, or in ritzy Georgetown, the rats are everywhere, Haskins said. Yet and still, people are still throwing garbage down, allowing their trash to overflow, and basically inviting the rats to hang out.

The DOH asks residents to: eliminate all clutter around the outside of homes and under porches; store any garbage in metal or heavy plastic containers with tight-fitting lids and place trash at point of collection shortly before pickup not days in advance; remove weeds and debris near your property/yards where rats can hide easily. Plants such as English Ivy, Periwinkle, Pachysandra, and Hosta are known to be cover for rats; remove uneaten pet food, and store pet food in secure containers; and add metal weather stripping and trim to doors to prevent rodents from gnawing and entering underneath.

Many people travel to Florida each year for vacation. Even those from Phoenix make their way to see that famous mouse and the tranquil beaches. However, a vacation this year could leave travelers bringing home more than memories.

The conditions are right in this Southern state to help spread this tropical bed bug. People are traveling and could be moving these bugs from state to state.

The tropical bed bug, like their cousins, feed on human blood. A bite from either species can cause itchy, rash-like reactions along with psychological distress.

State officials in Florida are urging homeowners to report any bed bug sightings that fit the criteria for this tropical bug. They are urging customers to send their bugs to the University of Florida in Gainesville for further identification.

Though these bugs have not been spotted in Arizona, it is just a matter of time before they could arrive.

Bed bugs are a problem in these Florida cities

Looking to avoid bed bugs? It may be best to stay clear of certain Florida cities.

Orkin released a ranking of the top 50 cities with the biggest bed bug problems, and Tampa (31), Orlando/Daytona Beach/Melbourne (38), and Miami/Fort Lauderdale (43) made the list. This was Orlandos first time back on the list since 2011.

The top five worst offenders were Chicago, Los Angeles, Washington, D.C., New York City and Columbus, Ohio.

According to the news release, Orkin compiled the list by ranking the cities by the number of bed bug treatments that the company has serviced throughout 2015, both residential and commercial.

"Bed bugs are the great hitchhiker of the bug world, and they are very difficult to control without professional help," Orkin Entomologist and Technical Services DirectorRon Harrison, Ph.D., said in a release. "Bed bugs can travel in luggage and other personal belongings to enter your home. They don't just hide in beds they can be found in furniture, bed posts, rugs and even electrical outlets."

Orkin advises you to survey your hotel room for signs of infestation, lift and look in hiding spots for bed bugs, elevate luggage on a rack, examine luggage before or after a trip, and place all dryer-safe clothing in a dryer at the hottest temperature advised following a trip to avoid bed bugs.
