Bed Bug Public Policy: Bed Bug Laws, Legislation …

With respect to public policy, bed bugs have been a pest that has been "out of sight, out of mind" for many years. In fact, the U.S. Government ceased publishing its "How to Control Bed Bugs" publication in 1984. However, over the past several years as bed bug populations have increased, effective control of these challenging pests has been a societal wide problem - one that has caught the attention of regulatory and legislative officials at the federal, state and local levels.

By way of example, legislative bodies in Alabama, Arizona, Illinois, Maine, New Jersey, New York, Ohio and Pennsylvania have considered bed bug legislation over the last two years. Illinois, Maine and New York all adopted bed bug laws in 2010. Municipalities across the country are looking at the issue. Examples of such proactive local jurisdictions include Jersey City, San Francisco, New York City, Boston, Cincinnati, Detroit, Yonkers, NY and Ocean City, MD. And of course, numerous agencies of the Federal Government are working on bed bug control. Federal legislation has recently been introduced on bed bugs.

The National Pest Management Association has been working with government officials as part of a national strategy on bed bug eradication. Samples of the association's position papers on key issues regarding bed bug policy and bed bug laws can be found here:

Maine Draws up New Bed Bug Law, Title 14 M.R.S.A. 6021-A …

Aside from the overuse of the words reasonable and unreasonable with no detailed explanation, as laws and lawyers tend to do, Maines new legislation regarding landlord-tenant obligations as they pertain to bed bugs is pretty detailed and comprehensive, with very short response times to every action that the landlord or tenant must take-along the lines of 5 days for a landlord to make a physical inspection after being notified of the infestation, 10 days thereafter to have a pest control operator on the scene. It doesnt say what is considered reasonable notice for the landlord to give the tenant to come onto the premises but I imagine it isnt much different than the 48 hours that we in the Bay Area enjoy. What is interesting is that the landlord is given the right to force the tenant to comply with treatments. If the tenant does not comply, the landlord can come in and do the work for the tenant and charge fees. Woe! Thats pretty hardcore. Given that the burden of the cost of treatment still lies with the landlord, I agree, uncooperative tenant should get his home taken over and then handed a bill. But what if the tenant doesnt agree with the method of treatment?

In San Francisco, as Ive cited a couple of times, there is a clause that requires landlords to use non-chemical treatments if feasible. I dont know if Maines new legislation specifies the same, but I highly doubt it. Also, even with this clause, it is well known that most landlords usually do not foot the bill for the more expensive thermal remediation or eco-friendly pest control operator. So what will happen if a tenant agrees to treatment but not the kind that the landlord chooses? It would be great if Shankman & Associates can answer that for us.

THE quote-of-the-week award goes to Ward 12 Alderman Keith Hirschmann. "There are a lot of scourges, a lot of things to worry about in the city," he told members of the Administration Committee on Tuesday.

True, and city officials took aim at several of these scourges last week: spice (a.k.a. synthetic pot), abandoned buildings, bed bugs and, at least in the view of Hirschmann, poker machines.

Hirschmann launched a crusade against the devices after it was revealed earlier in the summer that a West Side pizza shop that was the target of drug bust had apparently relied on the machines for revenue far more than fresh slices.

After meeting with police officials and the city clerk, Hirschmann drew up detailed amendments to the ordinance governing "amusement devices," which he presented to the committee on Tuesday.

The amendments had two main components. One would raise the current $2,000 annual permit fee by $500, with the additional revenue going to a special account to support the investigative work required to prove a poker machine is being used for gambling. The other would require criminal background checks for permit seekers.

The machines, in case you haven't heard, generate about $240,000 annually for the city.

It's safe to say most of the aldermen haven't been too receptive to the several ideas put forward by Hirschmann, one of the board's two Republicans, since he rejoined the board this year. But his ordinance had a good hearing, even if the committee's chairman, Alderman Joyce Craig, was skeptical.
